This morning and afternoon I watched a Q&A session held in the Upper House of the Japanese parliament (the Diet).
There, an LDP (opposition) lawmaker pointed out a specific provision of law that stipulates concrete cases where the Public Prosecutor General must be directly commanded by the Minister of Justice so as to handle them.
The cases are related to a crime of civil strife, a crime involving diplomacy, etc.
This provision is called Shobun-Seikun-Kitei in Japanese, since the Public Prosecutor General must directly receive an order from the Minister of Justice in investigating and filing a formal charge against a suspect involved.
Only in these specific cases, the Public Prosecutors Office of Japan is directly subject to a politician who happens to be the Minister of Justice as appointed by the Prime Minister.
Japan is a country ruled by law as much as America and Europe.
But, China is a country ruled by the Chinese Communist Party and those who have any power associated with the Party. Arbitrary application of laws and regulations is the norm in China.
Anyway, P.M. Mr. Naoto Kan should have requested the Minister of Justice to apply the provision, Shobun-Seikun-Kitei, to the case involving the Chinese illegal fishing boast whose skipper was arrested within the Japanese sea territory around the Senkaku Islands.
What do you call such a provision in English?
Anyway, it will take 30 years for you to learn every important provision of law and know its implication and association in any large country with long history, which however does not necessarily make you wiser and cleverer than, say, gangsters of some sort.
It is your pride as a man of justice that puts you above the ability of any gangsters.
